WARRANTY NOTE: Henceforth, in this document, the word (Company) shall be considered the same as Scavenger Backwater Motors, inc.
SECTION 1: TWO-YEAR LIMITED WARRANTY: The Company warrants, that for a period of two (2) years from the date of purchase or delivery date, whichever occurs last, it will replace or repair, free of charge, for the original purchaser only, any frame component part, excluding those parts which are covered by the ONE-YEAR LIMITED WARRANTY, manufactured by the
Company, found upon examination by the Company or its assigned representatives, to be defective in material or workmanship or both.
SECTION 2: ONE-YEAR LIMITED WARRANTY: The Company warrants, that for a period of one (1) year from the date of purchase or delivery date, whichever occurs last, it will replace or repair, free of charge, for the original purchaser only, any defective bearings, belts, throttle cable, propeller and power shaft component parts, manufactured by the Company, found upon examination by the Company or its assigned representatives, to be defective in material or workmanship or both. All transportation charges shall be borne by the original retail purchaser listed on this warranty paper. This is the exclusive remedy under this warranty.
Failure by the original retail purchaser to: assemble, maintain, and operate said equipment or failure to comply with the specific recommendations of the Company shall rule this warranty null and void. TheCompany shall not be liable for any repairs, replacements, or adjustments to the equipment or any costs for labor performed by the purchase without the Company’s prior written approval. The effects of corrosion, erosion and normal wear and tear are specifically excluded from this warranty.
THE COMPANY MAKES NO OTHER WARRANTY OR REPRESENTAION OF ANY KIND WHATSOEVER, EXPRESSED OR IMPLIED, EXCEPT THAT OF TITLE, ALL IMPLIED WARRANTIES, INCLUDING ANY WARRANTY OR MERCHANTABILITY AND FITNESS FOR PARTICULAR PURPOSE ARE HEARBY DISCLAIMED, LIABILITY FOR CONSEQUENTIAL AND INCIDENTAL DAMAGES UNDER ANY AND ALL WARRANTIES, OTHER CONTRACTS, NEGLIGENCE, OR OTHER TORTS IS EXCLUDED TO THE EXTENT EXCLUSION IS PERMITTED BY LAW.
Notwithstanding the above shall bar any legal claim against the Company if legal action thereon is not commenced within the limits set forth in sections 1 and 2 of this warranty. This warranty constitutes the agreement between the Company and the original retail purchaser and no authorized agent is authorized to alter the terms of same without written consent of the Company.
SPECIFIC RECOMMENDATIONS FOR MATCHING HORSEPOWER TO BOAT SIZE Actual top speed and thrust claims tested under normal conditions by the Company will vary from designs and types of boats that said unit was tested under. YOUR BOAT’S APPLICATION MAY BE LESS OR GREATER THAN THE CLAIMS SET FORTH BY THE COMPANY IN IT’S ADVERTISING.
Returns
Items may be returned within thirty (30) days of receipt for a Refund/Credit or Exchange (less shipping and restock charges). Items must be returned in new condition, never used, and in the original manufacturer’s packaging. A Material Return Authorization (MRA) number is required for all returns. Refunds/Credit will not be issued for products returned without an MRA number. Contact Scavenger Backwater Motors, inc. to obtain an MRA number and any restocking charges that may apply to the return. You can ship the item(s) back prepaid via your preferred shipping method. We strongly recommend that you insure the shipment for your protection. Refunds/Credit will not be issued for returned items that are damaged in transit to Scavenger Backwater Motors, inc.
